Homebuyers, beware! Sellers may be watching. And listening.

Many homeowners have installed security cameras and smart-home devices and they can be anything from high-tech security systems to simple baby monitors. But are they legal? In Texas, yes, a seller may record video and monitor showings. However, recording audio is not legal. Texas rules require at least one party to consent to recording a conversation, so if the seller is not present, he can not legally record audio. 

Best advice to sellers: protect yourself by disclosing the presence of recording devices. And as for buyers: always assume you are being recorded and do not say or do anything you would not want the seller or listing agent to hear. And remember, even the porches many have eyes and ears.
